BREAKING: Huge Momentum for NJ!!! Connecticut Supreme Court Rules 4-3 FOR Marriage Equality

Breaking news and huge momentum for the campaign for marriage equality in New Jersey: the Connecticut Supreme Court, in the case of Kerrigan v Commissioner of Public Health, has ruled 4-3 in favor of marriage equality.

Any way you slice it, this is huge momentum for New Jersey's marriage equality movement. Here's GSE's statement on the decision, from Steven Goldstein:

"Today's decision in Connecticut has particular relevance to us in New Jersey.  Connecticut has had a civil union statute exactly like New Jersey's.   Today, the Connecticut Supreme Court said civil unions do not and cannot provide the equality of real marriage -- that civil unions don't work in the real world and that they don't provide the dignity and respect of marriage either.   These are exactly the points we've been making in New Jersey.  Today, Connecticut said, civil unions, with all their myriad of problems, are not enough.  

"This decision can't help but have enormous persuasive impact on New Jersey, not only because both states have had civil union statutes, but because both states are neighbors in the tri-state region.

"Garden State Equality salutes all the organizations involved in bring marriage equality to Connecticut, including Gay and Lesbian Advocates and Defenders (GLAD), the legal organization serving New England's LGBT communities; and our sister marriage equality organization in Connecticut, Love Makes a Family.

"All of us at Garden State Equality extend to GLAD and Love Makes a Family, and all the other organizations involved, our love and deepest appreciation.  They are among the all-time heroes for LGBT America."

The parallels to New Jersey are undeniable. Connecticut, like New Jersey, has a civil union law. But, the Connecticut Supreme Court found that civil unions fail miserably to guarantee the equal rights of marriage--rights like health benefits, financial security, as well as the basic dignity and psychological assurance for children and families.

This decision confirms what we in New Jersey have already found: civil unions don't work. They can't work. They can't be fixed. Marriage equality is the only way to guarantee equality. Some will certainly try to spin this, but the fact remains--this is a huge boost of momentum to movement for marriage equality in New Jersey!!

Like these once prevalent views, our conventional understanding of marriage must yield to a more contemporary appreciation of the rights entitled to constitutional protection. Interpreting our state constitutional provisions in accordance with firmly established equal protection principles leads inevitably to the conclusion that gay persons are entitled to marry the otherwise
qualified same sex partner of their choice. To decide otherwise would require us to apply one set of constitutional principles to gay persons and another to all others. The guarantee of equal protection under the law, and our obligation to uphold that command, forbids us from doing so. In accordance with these state constitutional requirements, same sex couples cannot be denied the freedom to marry.

The Connecticut decision overturns a state law that adopted civil unions without the impetus of a court order.  Here, civil unions were put into effect as a result of a court order.

Steven has declared that our court is now among the most conservative in the country (obviously gross hyperbole), but one wonders whether our Supreme Court will review its own very recent precedent.

The demand for marriages in Massachusetts has been far below the predictions (from both sides) even with the specter of a referendum to overturn the law (which seems highly unlikely now).  It will be interesting to see how many marriages actually happen in California before November.


Another nail in the coffin of the idea (4.00 / 4)
that civil unions provide equality. That's what this is. It's a huge momentum boost to that argument, and a blow to those who suggest otherwise.

It isn't a matter of either one day the light dawns and someone changes their mind or that there was finally one more piece of information and that finally tilted the balance.

Success involves persuasion of those who didn't start out agreeing with you.  To put it nicely, that isn't a skill that you and Steven seem to excel at.

If you really want SSM to become the law of the state, then having as many couples join in civil unions as possible is the wisest course of action.  Filing complaints with the State for the problems moves you beyond Steven waving a pile of paper and does create a tangible trail.  Otherwise, the Governor is going to recommend waiting the full three years for the Commission to "finish" its work.

actually tend to happen with great regularity in politics.  Among the most memorable is George Ryan's and Harry Blackman's - decades apart - where each declared "I will no longer tinker with the machinery of death."  Of all people, Ronald Reagan, upon having raised taxes in California, told the press "That sound you hear is the concrete falling from my feet."  Franklin Roosevelt, incidentally, won the Presidency by railing against Herbert Hoover's activist government and promised to lower taxes and cut government spending - until Keynes showed him a different way.  Abraham Lincoln decided that abolitionism was a worthy cause after reading Uncle Tom's Cabin.

Those are just off the top of my head.

The recognition that it was wrong to have black people sit in the back of the bus didn't happen just because of Rosa Parks, but the muscle of a bus boycott by the black community in Montgomery.

11,000 in the whole state of California?  Almost one-quarter from San Francisco.  Maybe ten percent of all the same-sex couples in the state.  Not even half of the ones with kids.  And you think you're going to get Ron Rice or Steve Sweeney or Shirley Turner or ... to move???

Jon Corzine moved the court "far to the right" when he appointed Rabner and Hoens to replace Poritz and Zazzali???

Even without digging up your earlier statement, this one is bizarre enough.

The concern troll posts in web forums devoted to its declared point of view and attempts to sway the group's actions or opinions while claiming to share their goals, but with professed "concerns". The goal is to sow fear, uncertainty and doubt within the group.

You continuously second guess and undermine GSE's efforts.

You repeatedly attack Goldstein on an area of expertise in which he is clearly your superior.

You seem to be claiming to be a progressive; yet you manage to engage in destructive negative arguments with people like Carol, Bertin, and others which leave a bitter tone in the air.  You've even managed to piss off Juan who is about as tolerant and nice a guy as one can find in the political arena.

You consistently oppose good solid progressives like Loretta Weinberg and you've lent much aid and comfort to the corrupt BCDO and its corrupt leader Joseph Ferierro by opposing Weinberg and her allies on this site.

As for being a "hypocrite"; to the extent that I fail to live up to my ideals, I plead guilty.  I'm working on it.  At least I have ideals that I'm willing to stand up for.   Thank you for reminding me of my imperfection.   No doubt there have been times when I've been too rough and/or ill mannered....and I've acknowledged them to Juan and others and have "chilled".

You speak of persuasion and winning people over; what a joke!  Your Modus Operandi is about as cuttingly vicious and ill tempered as any I've ever seen anywhere.  Your words are like paper cuts; yet when they yield a negative response from the recipients you cry foul.  Like all bullies; you are fine with dishing out the abuse...but whine when you get a taste of your own "toxicity" thrown back in your face.

You are capable of being funny and charming and clever when you try real hard; but when push comes to shove you get really cutting and ugly....and it's not appreciated.

The fact that you can "succeed" in getting generally good natured, calm, decent, patient, and smart  people angry and frustrated and disgusted with you should tell you something.  That is not a "gift".   That is not a "power"; it is a defect.
