Unanue committing voter fraud?

Republican Senate candidate Andy Unanue's campaign manager:
"Andy Unanue lives in New Jersey, he votes in New Jersey, his car is registered in New Jersey, he pays New Jersey auto insurance, and his business is in New Jersey. Andy Unanue is New Jersey."
Andy Unanue:
"For the past few years I've lived in New York. I'm in the process of moving back to New Jersey."
So if he votes in New Jersey but doesn't live here, isn't that voter fraud?

The Ocean and Atlantic County Republican parties lined up like sheep this evening to support a candidate who's campaign can't even figure out where the hell they guy even lives.

It's not a particularly snappy signature, but here's what I think we need in the next NJ Democratic State Chair.

It's amazing to me that nobody appears to have vetted this person. I mean... there is just so much wrong with him.

This guy is a gold mine.

This isn't voter fraud (0.00 / 0)

It is legal to live in one place and vote in another (one where you previously lived), just as it is legal to live in one place and continue to be a resident of another state.    Lots of people do it and it is legal.  

It may not be the best thing politically, but legally, it's fine.

NJ Division of Elections (who can register)

To register in New Jersey you must be:

  • a United States citizen,
  • at least 18 years old by the next election,
  • a resident of the county for 30 days before the election.
  • If Unanue is a resident of NJ, I believe he should have filed taxes with the state. Maybe he did. His campaign manager mentioned that he pays car insurance in NJ, but didn't say anything about where he pays taxes. Maybe he just left that out.

    I pay auto insurance in NH (0.00 / 0)
    As long as the car is garaged there, you can register and buy insurance for it.  I couldn't register it and use NH insurance and then use the car in NJ year 'round.

    So you can be a resident of another state and keep cars here legally.

    If you lived in New Jersey and move to New York, but regard NJ as your residence and intend to eventually return here, you are legally still a New Jersey resident.   This is the criteria that the IRS and the states use.  I was audited and it came down to this, so it's really true.

    I'm assuming that Unanue registered in NJ when he actually lived here, then moved to NY (without giving up his NJ residency) and voted in NJ,  and is now returning  to NJ.  It's all perfectly legit.

    If you are a NJ resident who moves temporarily moves to NY (whether for a month or many years),  you can voluntarily give up your NJ residency for NY residency, and reassume NJ residency when you come back.

    The point is that the government can't force you to give it up assuming you have ties (such as family) to your previous residency that indicates a likelihood that you will return.

    That means he lived in NY.  You cannot file your income taxes in one state as your primary residence and vote in another.
