Update [Juan]: Mercer County Democratic Chair Rich McClellan tells Blue Jersey: "Just for clarification purposes, as Mercer County Chair, I will be making no request for preferential treatment of any single candidate on the Mercer County Democratic ballot even though I have personally declared my support for the Clinton candidacy." It's expected that a random drawing will determine placement on the ballot.

Update 2 [Juan]: I'm not a lawyer, but this seems to be pretty clearly illegal. On May 5, 2005 a mid-level state court ruled in Schundler v Donovan that for primary ballots, all candidates should be given an equal shot to win a lottery for the best ballot position and that the state should use a method that "requires all the candidates to begin from the same position."

Update 3 [Juan]: Thurman Hart at NJ Voices:
In direct conflict of DNC rules, the State Committee is trying to ensure that Hillary Clinton gets to head up the majority of ballots in New Jersey for the Democratic primary. In an effort to cut off protests from the Obama camp, someone stayed up late at night dreaming up a rule that would give Obama a few ballot-top positions as well.

Update 4 [Juan]: A statement from Mark Alexander of the Obama campaign:
"The Obama campaign urges all County Clerks to conduct a fair and even-handed draw to determine ballot placement for the presidential candidates in New Jersey's February 5 primary.  Our campaign is dedicated to empowering people in our country-the power belongs to the people, and not to the elite few.  Every aspect of our democratic process should respect the people and must flow from principles of equality.  We hope that County Clerks will follow an impartial process for ballot construction that respects these principles of equality."
Update 5 (last one) [Juan]: The DSC is now requesting that ballot placement be by "open draw".

Last year, the Democratic National Committee put together a little something called "Delegate Selection Rules" for the 2008 Democratic National Convention, to ensure a fair and equitable process nationwide. Among the more obvious requirements is Rule 17-B:

Any individual or group of Democrats may sponsor or endorse a slate of candidates for convention delegates. But no slate may, by virtue of such endorsement, receive a preferential place on a delegate selection ballot or be publicly identified on the ballot as the official Democratic Party organization slate....

Obvious? Not in New Jersey.

Presidential Primary Ballot Construction LetterHere in the Garden State, our Democratic State Committee's attorney has submitted a letter (right) to the AG's office requesting that ballots statewide not only place the county Chairs' choice first, but in those counties where no endorsement has been made, to hold a two-step process to determine ballot position:

1- a drawing between only Hillary Clinton and Barack Obama to see which of their delegates will receive the first position, and which will be second, and

2- a second drawing among all the rest to see whose delegates will be placed in the remaining positions, third and below.

Some county Chairs are even interpreting the DSC proposal to mean that the Clinton and Obama delegates will automatically be entitled to the first two ballot positions in every county.

Absurd? Yes. Legal? Almost certainly not. Fair? Absolutely not.

Putting aside the question of whether county Chairs should ever have the power to unilaterally decide ballot position (they shouldn't) or to have their official endorsement appear on the ballot (most states have outlawed this practice), the really undemocratic part of the DSC's proposed plan is the elevation of Clinton and Obama to preferred ballot status statewide.

That plan clearly violates both the letter and spirit of the DNC's delegate selection plan, and puts our state's delegation at risk of disqualification.

And that wouldn't be democratic at all.

I agree with you, Noweeman.  This reeks and I'm not afraid to say it.

Any way you slice it, this is undemocratic. The fact that it violates the DNC rules aside, this is a shameful way to rig run an election.

I'm an Obama supporter and I want no unfair advantages for my favorite candidate. I'd prefer a victory that's actually meaningful.


What's even more crazy (4.00 / 3)
if indeed this was designed to benefit Clinton, as I suspect - is that it elevates Obama above the other candidates, and reinforces the notion that this is a 2-person race - the worst case scenario for Clinton.

...either Obama or Edwards were to drop out of the race.

As it is, they split the deeply progressive vote. 

A ballot frame that makes it seem like a two person race may well backfire on Clinton.

designed to benefit Clinton, per se, but to benefit those County chairs who come out on top when (if the polls be beleived) Clinton takes the NJ primary. This reeks of JERSEY politics. I doubt the Clinton canpaign had much, if anything to do with it. New Jersey has achieved amazing progressive goals in the recent past, but if you don't get busy cleaning up your own house, you will become the poster boy for "the ends justify the Means".

Just like it was New Hampshire politics that made a Clinton staffer go after Obama's drug use (hypocritical? "I did not inhale!"). 

Just like it was Iowa politics to push fears over Obama's religion.

I'm sure this is just a "Jersey politics" thing.  You're right.  There's no pattern here.  Pay no attention to the insanely ambitious silly little man behind the curtain.  Nothing to see.  Move along.

I'm sure we are only days away from discovering this was all done by a person connected with Clinton's campaign who will then resign from her campaign because Hillary doesn't play that way.

At least, that's the way the story plays everywhere else.

To hell with what she wants, let's make Rosi Efthim the next DSC chair.

If we were really concerned with having a strong turnout at a reduced cost, we would have the whole primary vote by mail.

Hoist On Their Own Petard (4.00 / 1)
Northgrave's request that the vote for President and delegates be done with a "single button" takes away the only rationale for his ballot order request.  In the June primary, there is a drawing of those slates that file a full slate of freeholders (which is usually only the organizational slate) and then a drawing for anybody else.  This is probably how carolh wound up on Column 4.  This is done because when there are multiple candidates to be selected (meaning you have to push more than one button to vote for all the offices) you should give preference to those full slates.  Northgrave initially carries that logic over to the presidential primary which would mean Clinton and Obama in all districts.  However, even that is discriminatory in the areas where other candidates filed a full slate.

BUT, if you are also going to request that only a single button needs to be pushed to vote for a nominee and their delegates (and the selection plan provides for a procedure in case more delegate seats are elected than there are candidates nominated to fill them), then you don't need to do anything other than a random draw of the candidates who filed statewide petitions.

....how the county Chairs hold de facto dictatorial powers. 

The more power they wield, the more "chits" they have to play/pay with.  It all translates into money at some point.

The status quo is no mere accident.

We need to democratize the process.

If New Jersey's (per)version of the DNC rules turns out to be legal; then there needs to be legislative reform.

This situation is just one more symptom of the systematic corruption that pervades NJ politics.

Earlier in the year, Mr. McClellan made a good showing in Mercer for an open and transparent candidate selection and nomination process in the runup to this year's Legislative races. He ran an inclusive convention. And today he stood for fair play. Kudos to him.

that when it comes to the "business" of political parties the Democrats are no more democratic than the Republicans.  The situation in Washington should be a lesson, there are decisions made at a level to which most of us are not privy.  This latest situation just happened to get to the public.  How many similar actions don't.

I don't know, maybe I'm just angry and frustrated at all the "caving" that's been done in Washington this week.
