Marriage Equality -- in Iowa!

by: Hopeful

Thu Aug 30, 2007 at 05:57:22 PM EDT

Given the issue's importance here in New Jersey, I thought I should bring up this Iowa judge's ruling that same sex marriages must be allowed:

Judge Robert B. Hanson ruled that couples cannot be denied licenses to marry or marriage certificates or "in any other way be prevented from entering into civil marriage pursuant to Iowa Code Chapter 595 by reason of the fact that both persons comprising such as a couple are of the same sex."

He ordered the Polk County recorder's office to issue marriage licenses to gay couples.

No doubt there will be judicial appeals and perhaps even legislative action.  In any case, it will no doubt raise the issue for Presidential candidates.  Those who visit New Jersey could learn about the half measure of civil unions.

Now that's progress! (4.00 / 1)
Not just in mandating the issuance of marriage licenses to same-sex couples--although that's great as it is.  But the decision seems to recognize that every marriage is a civil marriage--whether or not it also involves a religious rite of some kind.  That's fundamental. and it doesn't discriminate.  Doubtless this will be appealed by the right-wing crazies, but it stands as an important judicial decision nonetheless.

Alas, it's being contested (0.00 / 0)
And the judge's order has been stayed while it's being appealed.  One couple did get married...all the rest are still waiting.

We--straight and gay people favoring marriage equality--will also wait.
