Still up in the air

Fri Apr 27, 2007 at 10:00:32 AM EDT

It's been a while since my last diary on this, but I wanted to give you all a better timeline of what has been happening with LD37.

April 11, during the day, Senator Weinberg and the LD37 team met with Union leaders in Bergen County to get their opinion of how to address the offer of withdrawal from the Wildes, Zisa, Wilson team.  The majority view was that the LD37 incumbents should accept the offer and move to the BCDO line to avoid an expensive primary battle.

After the meeting with the Union leaders, the LD37 incumbents met with the Real Bergen Democrats candidates - 20 to 25 people at least, and discussed the course of action on the offer.  It was decided that they should take the offer ONLY IF THE REAL BERGEN DEMOCRATS line stayed intact.

In order to accept the offer of withdrawal and the move to the BCDO line discussed at the press conference on Thursday April 12, several things had to happen:

1. Wildes, Zisa and Wilson had to withdraw as candidates (in writing), which had to be  certified.
2. The BCDO Committee on Vacancies had to then certify the LD37 incumbents as the replacements on the BCDO line.
3. Their paperwork had to be submitted by the deadline.

Because the paperwork for this was submitted past the deadline by the BCDO lawyers, the Attorney General of NJ must now get involved to place the LD37 incumbents on the BCDO line.

After April 12, the BCDO Lawyers demanded that the Real Bergen Democrats freeholder candidates withdraw.  That would place our whole Real Bergen Dems slate in jeopardy because you need county candidates to bracket together on one line.

The LD37 team was harassed, threatened with legal action, bullied, told that the BCDO would reinstate their withdrawn candidates, and generally given a hard time about the county level candidates.  Those candidates offered to run although they knew we did not have the resources to support their run.  They were chosen because they were excellent candidates who knew the possibility was great that they may lose to the BCDO county slate.  But they agreed to take the chance so we could have a unified slate.

The BCDO then demanded that the LD37 team publicly endorse the BCDO county candidates.  Which the LD37 team rejected.

Then last week, Kathleen Donovan - the County Clerk drew the lottery names for the placement on the ballot, after accepting all the paperwork to create the Real Bergen Democrats line filed and submitted by Real Bergen Democrats Campaign manager Brenda Allen.  Ms. Donovan's lawyer, John Carbone then attempted to throw out the whole Real Bergen Dems slate by insisting that we did not officially state who our campaign manager is.  After Ms. Donovan accepted form after form signed by - you guessed it - campaign manager Brenda Allen.

And so, not only is the BCDO in court to get the LD37 incumbents to switch columns, but the Real Bergen Dems are in court to stay together as Column 1 on the ballot.

That is why the crypticness of the last 15 days.  It is all still up in the air.  But at least now, the BCDO has backed off on requiring that the Real Bergen Dems line dissolve.  The question is whether the AG will let the LD37 incumbents switch columns and if the judge will rule that the Real Bergen Dems will stay together.

At this writing any folks who want to help the Real Bergen Dems candidates - please visit the website and volunteer, we are continuing the campaign regardless.  The candidates will still be identified on the ballot as Real Bergen Democrats regardless of where they end up.  In fact the LD37 incumbents will be in Tenafly for the street fair on Saturday if you want to meet them and talk to them in person.

So, that's the story.

Loretta also wanted me to pass along her thanks to the Blue Jersey blogging community for your continued help, support and patience.

Paperwork was timely (0.00 / 0)
According to a letter dated today from the office of the Attorney General, the BCDO did, in fact, submit the required paperwork to the Division of Elections in a timely manner, and the substitution of Weinberg, Johnson, and Huttle was timely effected on April 18, 2007.  The Attorney General has therefore certified that Weinberg, Johnson, and Huttle will appear on the ballot as Bergen County Democratic Organization Candidates.

Thank you for clarifying... (0.00 / 0)
and not continuing to spin us. Your insight certainly seems to clear up CarolH's claim:

"Because the paperwork for this was submitted past the deadline by the BCDO lawyers, the Attorney General of NJ must now get involved to place the LD37 incumbents on the BCDO line."

Too bad everyone isn't as forth right.

The one thing that sticks with me though, is how Loretta and team can continue to bash the BCDO while at the same time moving over to their column and accepting the organization endorsement. Doesn't the saying go, "Don't insult the chef 'til after you've had dinner?"

To continue spouting off anti-BCDO rhetoric is not only hypocritical but it's just bad politics on the part of the successors.

If the AG finally ruled JUST TODAY (0.00 / 0)
that Loretta, Gordon and Valerie will move to the BCDO column, then that is where they will be.  The attorney general did have to get involved as I stated and only came to a decision TODAY.  The question now is, how can Kathleen Donovan's compromised lawyer, John Carbone, continue to insist that Real Bergen Dems had no campaign manager and thus disband the Real Bergen Dems line?

One Vote. Yours. It really does matter.

maybe rumor - maybe not (0.00 / 0)
While I cannot verify the identity of the people involved, more than bad rhetoric on behalf of certain posters on this site may be the cause of this situation.  It turns out that the Division of Elections was prepared to certify the substitution of Weinberg and Co. for Wildes and Co. last week, until they received a phone call from someone claiming to be calling from Weinberg's office.  This person apparently told the Division, in no uncertain terms, that Loretta had no intention of switching slogans or columns, and would not accept any nomination to fill a vacancy.  It then took more than a few phone calls from Loretta's attorney, and finally a letter to the Attorney General to clear up the confusion.  Given the BCDO's enthusiasm for the switch, I doubt the offending call came from the BCDO.

Re: maybe rumor (0.00 / 0)
I really hope I'm misreading this.  Please tell me you're not seriously suggesting that Blue Jersey is to blame here.  That's a pretty big stretch.

I was (0.00 / 0)
Upon further review, I think I was, in fact, misreading this.

[ Parent ]
If you can understand it (0.00 / 0)
please explain it to me.  Is this anonymous Dennis Oury flunky implying I have done underhanded things besides voting for Loretta and Valerie, and trying to explain the complicated nature of primary politics?

It is amazing how they try to make us question the motives of Loretta Gordon and Valerie, when we all talk to them all the time.

Are they telling me we should believe the folks who forged signatures in Bergenfield, illegally challenged duly elected committee members from Teaneck and Tenafly, tried to institute Bylaws changes to dilute out votes to change the outcome of an election, and tried to bribe Gordon Johnson with a high paying job if he would quit the race to let Ken Zisa run?  And we should believe this Oury flunky, why again exactly?

Actions speak much louder than propaganda.  A few belated blog posts to throw doubt on my motives cannot erase years of pay-to-play deeds that have resulted in local borough governments beholden only to big BCDO donors.  As a CC member of the BCDO I am appalled at the way the organization is run and I am trying to change it for the better.  That is my motivation, I wonder what their motive is.

Unfortunately, I probably won't have news on this before the Judge hears the case in May to see if the Real Bergen Dems line stays together.

One Vote. Yours. It really does matter.

there you go (0.00 / 0)
there goes carol with the friendly rhetoric again.  flunky.  that is a good one.  that appears to be your go-to-move.  someone questions carol's credibility and she starts in with the name calling.  you can spin all you want. you can regurgitate what ever new re-worked line you've been fed each day.  and you can keep making your claims without facts to back them up.  i see through you.  this is the part where you call me a name.

I think... (0.00 / 0)

the point was that name-calling isn't necessary at all, and actually against the community rules here.  No one on Blue Jersey is required to post under their own name.  That said, I also don't think baiting each other into name-calling is necessary, either.

You kids play nice, now.

if you hadn't noticed, Scott was saying that perhaps we shouldn't be so combative with each other.  Maybe it it because we are on the same team where so many issues and candidates are considered.  I like to elect Democrats.  Do you like to elect Democrats Carol?

Yes (0.00 / 0)
I like to elect HONEST, COMPETENT Democrats.  Loretta Weinberg won nearly 75% of the General election last time with Valerie and Gordon on the ticket.   Wondering why Ferriero tried to destroy a successful ticket like that is what makes me lose sleep.

One Vote. Yours. It really does matter.

to be fair (0.00 / 0)
the 37th district would go 75% to any Democrat.

In the 37th District we won't settle (0.00 / 0)
for "any Democrat" or whatever person Joe Ferriero promised the job to.  We want HONEST, COMPETENT, EXPERIENCED Democrats: Loretta, Valerie and Gordon.  We want Democrats who actually listen to the rank and file.  We want Democrats who lead by inspiration, not retaliation. You know, Democrats who ask for my vote instead of denying me my right to cast it.

One Vote. Yours. It really does matter.

I still don't know  about with this voter intimidation stuff we hear from you.  Can you also ever comment without it being a partisan talking point?  I am quite sure there is more that unites us than divides us (aside from the fact we are both Democrats).

about wanting a fair election - even at the county level?  Read my diary One Vote.  If you don't understand my point after reading that, I simply can't help you.

Funny (0.00 / 0)

I think you lie a lot.

Just so you won't miss it, I am reprinting my first post at Blue Jersey about the goings on at the BCDO as a new diary called Real Bergen Democrats Prequel. Enjoy.  If you still plead like Alberto Gonzales who doesn't know what anyone is talking about, then the least you can do is make your case like everyone else here.  If you have an opinion, back it up with some solid facts.

I didn't embellish the fact that the ENTIRE Tenafly County Committee was moved onto column 4 in last year's primary.   I did not embellish the fact that even though I was duly elected, I was challenged at a special election at the BCDO as were most of my Tenafly county committee members.  I did not embellish the fact that the ENTIRE Teaneck County Committee was challenged to vote at the same election.  I did not embellish the fact that Timothy Driscoll and other Bergenfield members of the CC were the victims of FORGERY to get them off the CC after they expressed support of Senator Weinberg.  I did not embellish the story of Joe Ferriero's re-election where his supporters behaved like mafia goons and intimidated and shouted down his opponent.  Everything was true, right down to the detail of the the Stars and Stripes missing from the room.  I did not embellish the fact that the Chairman tried to dilute votes by changing the Bylaws of the Bergen County Democratic Committee.  I didn't even embellish the fact that Gordon Johnson was offered a job to quit the Assembly race.

In other words, it all really happened.  There are dozens of witnesses. You'll just have to deal with it.

One Vote. Yours. It really does matter.

at least you're friendly.  I'm a "liar" Ferriero is "mafia" what other nice things do you have to say?  If you are referring to Bob Gulack getting up on stage and screaming at people that they are puppets, well I don't know if anybody reacted like "mafia" or whatever you claim, but I am sure folks weren't happy.  I look forward to more inspiring words from you.  It is educational.

I was (0.00 / 0)
only 15 feet from Mr. Gulack and I could barely hear him.  The only other person on this blog - a Ferriero supporter - who said they were in the same room, admitted they were "in the back of the room", way on the other side of the gym with 600 people in it. The shouts they heard weren't coming from Mr. Gulack.  They could not have heard him from there.  The shouts they heard were the BCDO FOJ who were shouting Mr. Gulack down.

Before Mr. Gulack gave his speech he emailed it to folks.  If Ferriero's supporters had not shouted him down, here is what they would have heard.  Word for word.

STATEMENT OF ROBERT GULACK,

 CANDIDATE FOR CHAIRMAN

OF THE BERGEN COUNTY DEMOCRATIC COMMITTEE

FOR IMMEDIATE RELEASE      FOR MORE INFORMATION, CONTACT:

June 13, 2006                                                              Robert Gulack,

It is as incredible to me as it is to you that, after only a few days as an elected member of this committee, I should be rising to make this speech, but our party is facing a genuine emergency.  As we all know, Joseph Ferriero has made our party a laughingstock.  He has made Bergen County into the ultimate playground for pay-to-play – a sort of Six Flags where big money and puppet politicians swap favors.  There is a wrong way to do politics, and it consists of selling off our state to companies seeking pay-to-play contracts, and using the campaign contributions you get to bury all opposition and bully the legislature.  We have a political party in the United States for people who want to do these things.  It’s called the Republican Party.  There is a right way to do politics, and it’s the way that my group won our County Committee seats in Fair Lawn – by Xeroxing simple handouts, distributing them by volunteers, and going door-to-door to talk to our neighbors.  We don’t need to sell off New Jersey to buy political office for ourselves, and only lazy cowards will tell you otherwise.  The more we sell of New Jersey, the less of New Jersey is left for our children.  We need to stop sacrificing our children for the sake of our politicians.  We need to start sacrificing certain politicians for the sake of our children.

My name is Robert Gulack and I offer myself as a candidate for chairman in order to provide an alternative to Ferriero.  I am a graduate of Yale Law School, where I served on the Yale Law Journal.  I then became a member of the Maryland and Washington, D.C. bars, practicing law with a law firm in Washington until I became a law enforcement attorney with the federal government ten years ago.  I helped found a new nation-wide union at my federal agency.  I serve as a union steward, and, as the Bergen Record article of May 26, 2006 discussed, I have worked for nearly five years to get the EPA to clean up the World Trade Center debris now endangering workers and residents in New York City (and, I believe, Jersey City, as well).  I have tried to do something about the fact that our Bergen County commuters are commuting to polluted jobs.

For more than two years, I have worked with Concerned Citizens Reclaiming Fair Lawn in a largely successful effort to protect Fair Lawn’s recreational spaces from being made into townhouses.  I have also been a leader in the effort to bring the Radburn planned community into conformity with the New Jersey state law mandating “fair and open” election processes.  On June 6, 2006, I proved that I have the political know-how to defeat unlimited campaign expenditures by the Bergen County Democratic Organization.  Today, I ask for your vote.  Two hundred and thirty years ago, the men of George Washington’s army battled and bled in New Jersey.  And as they marched past the spot where we are standing today, they sang this song: “Let tyrants shake their iron rod.  Let Slavery clank her galling chains.  We fear them not: We trust in God.  New England’s God forever reigns.”

I still don't have an answer.  But, you can log onto the Real Bergen Democrats News webpage and check in:

 http://www.realbergendemocrats.com/news/releases/20070426_statement

It explains their position much clearer than I can, and it is official.  We should hopefully have some news to share today, but by logging on to their website, you will probably get that news quicker than I will be able to report it today.
