Corzine Asks Farber To Resign

by: Juan Melli

Tue Aug 15, 2006 at 12:08:09 PM EDT

Bad news for Farber:
Attorney General Zulima Farber violated the state's code of ethics but did not break the law when she went to the aid of her boyfriend during a traffic stop, according to a report issued this morning by the special prosecutor investigating the Memorial Day weekend incident.

"Her conduct does raise significant ethical questions that must be addressed," special prosecutor Richard Williams wrote in the 43-page report. "While there is evidence to establish that the attorney general was aware of, and acquiesced in, some of the favorable treatment received by Mr. Goore, I do not believe that conduct warrants criminal prosecution."

PoliticsNJ reports that Corzine has asked for her resignation:
Gov. Jon Corzine, who appointed Farber when he took office in January, had pledged a zero tolerance policy for members of his administration who place "private interests above the public good."

Sources close to the Governor say that Corzine has asked Farber to resign.

Farber's term does not expire until January 2010, and the State Constitution prevents her from being fired.  Her removal can come only through resignation or impeachment.

It's over. Time to step down.

Update (1:15 PM): According to Wally Edge, Farber seems unwilling to step down:

Zulima Farber is strongly resisting advice from friends that she resign quickly, according to a source close to the Attorney General.

It would behoove Ms. Farber... (0.00 / 0)
To not stay on longer than her welcome. If she decides to stonewall, some of our state legislators could well decide to begin impeachment proceedings, or at least start making those noises. At this time in our state's history, that would just be an unnecessary distraction.

We got much bigger fish to fry.

Please, Ms. Farber, leave graciously.

The nom de plume has a long and distinguished history.

Kudos to the Gov. (0.00 / 0)
For making a quick decision. I was half expecting the report to be delayed two or three months, and than have the Gov. review it for a month in an attempt to have people forget about the issue.
But I am pleasantly surprised. His quick action is admirable.

If She Refuses To Resign... (0.00 / 0)
Corzine should fire her straight out.  She has no defense against the charge of unethical behavior.

I don't recall anyone here standing up for her; and that's a good thing!

I hope the Guv appoints someone even more progressive with impeccable ethics and who will embark on a clean up campaign of the systemic corruption that pervades NJ's politics and commerce!

Let's shake things up Governor Corzine, that's what you were ELECTED TO DO!!!

She can't be fired (0.00 / 0)
Unfortunately, she can only resign or be impeached.  Corzine does not have the authority under the law to fire her.  And based on her history, I could see her forcing an impeachment just because she believes in her own cause.

Can Farber be Fired? (0.00 / 0)

Over at politicsnj.com,  there is a link to a study done by the Office of Legislature Services last year in which they concluded that the State Constitution permits the Governor to fire both the Secretary of State and the Attorney General, should he choose to.  It hasn't been used, but OLS seems to think it would be legal.
