GOP Voter Suppression (Again!)

There are few Republicans that I would consider voting for. But if I see a member of the GOP who I think would bring the party back to becoming a viable loyal opposition instead of a bunch of extremist corporatists, I would consider voting for that candidate.

Shelley Lovett was such a candidate in the recent election, a Republican running for Assembly from the Fourth Legislative District in Gloucester County. While she lost to political neophyte Gabriela Mosquera, Lovett was the kind of Republican we need in Trenton. When I met with Lovett back in October, she said "public education is the most important thing we can give our children" - heresy in the Christie religion.  Lovett was open to the idea of giving voters a say in the establishment of charter schools and had concerns about the use of standardized tests in teacher evaluation as proposed by Governor Christie's "reforms." Lovett's Assembly running mate, Pat Fratticcoli, is also a member of that dying breed of moderate Republicans, and had either one been elected, I would not have been disappointed.

Mosquera, on the other hand, was less prepared to talk about the issues when I met her. She deferred much of the discussion to her running mate, Paul Moriarty. I'm sure that as a new Assemblywoman, Mosquera will vote more in line with my philosophy than Lovett would have.  But increasing the small number of sane and rational Republicans in Trenton is important, too. At least that's what I thought until I picked up this morning's Philadelphia Inquirer.

I was surprised to read that Lovett is filing a lawsuit to nullify Mosquera's election. Lovett's lawyers assert that Mosquera does not meet the residency requirements because the newly-elected Assemblywoman, an immigrant from Ecuador who became a US citizen at age 18, has not lived in the district long enough.

It seems that Republicans believe in the electoral system only when they come out on top. The stealing of the 2000 presidential election is the epitome of their belief. Chris Christie's lieutenant governor's stripping long-time New Jersey resident Carl Lewis from the ballot is another. Republican voter suppression efforts in Ohio, Florida, and across the nation are legendary.

Unlike the Carl Lewis case in the Eighth District, the voters in the Fourth District had a choice. Lovett brought up the residency issue during the election, but the voters opted for Mosquera by a wide margin. If Lovett wanted to pursue this in the courts, she should have done so prior to the election.  She claims she didn't have the money for a lawsuit then, but her lawyers are working pro bono, so that rationale rings hollow.

Secretary of State Kim Guadagno should do the right thing this time, and certify Mosquera's election at the earliest possible time. And I encourage Lovett to stay the moderate course and help bring the GOP back into the real world. Both of these women represent the type of person we need in Trenton.

If this issue was raised at all during the campaign, I must have missed it. Lovett would have had no trouble finding herself a lawyer to do this pro bono before the election.

It's unfortunate that the GOP Assembly candidates were not able to effectively get their message out as I agree with Deciminyan that either candidate would have represented us well in Trenton.

Having said that, Mosquera moved into her home in Gloucester Twp in Dec 2010. GlouTwp was part of LD4 before and after redistricting so I don't see what redistricting has to do with this.

So the question is, where did she live between 11/8/10 and the time she moved in December? The Inquirer article doesn't say. She either lived in the district or she didn't. It sounds binary to me.

The issue was brought up by Lovett at an editorial board meeting, but at that time she did not make a big deal of it. IMHO, we should just get rid of residency requirements. If someone from Topeka Kansas wants to run for NJ Assembly, go for it. Let the voters decide.

the residency requirement at this time is the law whether we like it or not. I have a feeling the GOP assumed one of their candidates would get DiCicco's seat, and were surprised by Mosquera's victory on Moriarty's coat tails. Otherwise they would have pursued the residency question more aggressively during the campaign.

Reed Gusciora... (0.00 / 0)
...was allowed to "move" to Trenton to run for re-election in LD15 after Princeton was removed from that district and placed in LD16.  If that didn't violate residency rules, I don't know what else could have.

The residency rules for legislative elections should probably be the same as the rules for congressional elections, which are, I believe, that you have to be a registered voter, affiliated with the political party whose primary election you will be running, in NJ at the time that you file your nominating petitions.

Otherwise, residency should be more of a political issue than a legal issue.
