State Secrets: Who Was in that Helicopter?

As Rosi reported this morning, the Wall Street Journal got ahold of Christie's helicopter records - after Christie said he couldn't release them.

But a lot was blacked out. In every single one they black out the names of the other passengers and how many passengers were traveling.

Legal? Or some kind of weird cover-up? More below the jump...

So, here's the deal. Under the Open Public Records Act (OPRA), you can't just choose to give what records you want or not to the public. There is a strong presumption in favor of disclosure - in fact the burden of proof is on the agency that doesn't want to disclose the records ("The public agency shall have the burden of proving that the denial of access is authorized by law.")

You need a specific reason to exempt a record from disclosure. From what's been reported, I am guessing that this is what the Christie administration is claiming:

security measures and surveillance techniques which, if disclosed, would create a risk to the safety of persons, property, electronic data or software;

So here's the line of argument you'd have to follow to say that you can't disclose who Christie was flying with. It's a risk to (that person? Christie?) for their names to be disclosed? Or it would create a risk to the helicopter (property?) to know that certain others were flying with Christie?

Huh?

I'm not an expert on security. But this seems sketchy.

One key question - did prior Governors when they disclosed their helicopter records (and this whole mess has made it clear - they did) omit who they flew with? Google hasn't provided me with any answers.

I hope the Journal is following up. And that they have a good lawyer.

I can understand if they do not want to release specifically which and how many members of the Executive Protection Unit accompany him, but others including family, staffers, friends, donors, political consultants, and government employees should be released as public information.

We don't need to know this (0.00 / 0)
As long as we know the locations and purpose of the trips the rest is irrelevant.  Maybe he took his kids along for the ride, or his wife (she accompanied him on the baseball trip), maybe he stopped to pick-up a hitchhiker, or maybe he took his girlfriend.  We'll never know, and it really doesn't matter.

This story has lost its legs, and now we're beating a dead chopper.  Time to move on.
