When All Else Fails… Lie. Christie Claims NJN Workers Not Entitled To Severance Pay

After handing NJN Workers 45 day layoff notices, in another cruel twist of the knife, Chris Christie has followed that up by refusing to recognize the state's contractual obligations to NJ Public Workers entitlement to the Displaced Workers Pool (4 months severance pay) outlined in their contract.

Mr. Christie might want to head back to law school for a contract law refresher or hire some lawyers who can read a contract and amendments before making claims that are false.

The contract was negotiated and agreed to in good faith for the duration of the contract period and just because Mr. Christie feels like picking and choosing what he wants to honor doesn't change that fact.

It is astonishing that he claims to be a lawyer yet has acted in every way to usurp lawful and contractually binding agreements based solely on personal opinion and his desire to weaken and destroy the unions.

In the same week Mr. Christie has also refused to acknowledge PERC's (Public Employment Relations Commission) ruling in favor of the union contract with regards to taking Black Friday as a holiday. One would almost wonder if he is making sport of attacking public workers for his own amusement. Many of these people have already made plans to be with family and likely spent hard earned money for travel and accommodations.

Not acknowledging or advising whether he plans to appeal the ruling leaves a lot of folks in a cruel limbo with regards to their families.

His defense in initially denying the Black Friday holiday was that obtaining legislative action to implement the Black Friday day off would sacrifice legislative time and resources necessary for implementing his "Tool Kit" but, by design, the MOA was agreed to by both the Union and the State under Governor Corzine to waive the requirement of legislative intervention rendering Mr. Christie's current argument invalid and a distraction. Is it any surprise that he waited until the final hours before the holiday to throw another one of his monkey wrenches into the works considering he has whined over this agreement since the day he took office, calling it an "exquisite pair of handcuffs".

Maybe it is just one more example of his perception that there is one set of rules for Mr. Christie, another set of rules for everybody else.

As one contributor mentioned on while commenting on another topic," we knew it was coming" .

Instead of sitting back and hoping things would not come to this,and then running to court with the hope of winning a short term fix, the CWA should have been creating an action plan explaining what it actually costs and what benefits the taxpayer gets from NJN.

With this Governor you cannot be reactive,you must be proactive.    


Over-simplification and Misperceptions (4.00 / 1)
CWA does bear its share of responsibility but it is erroneous to claim that the CWA leadership is just "sitting back and hoping things would not come to this". The leadership of CWA can only do so much with the tools and access they have. Between the members failing to vote for the Strategic Industry Fund (fighting money), the press being far more interested giving page space to Chris Christie and his administration rather than the unions and union leadership, by Mr. Christie's carpet bombing attacks on every sector of the public employees in the state, it isn't a matter of the CWA sitting back but rather being overwhelmed and under-supported.

This perception of the CWA being ineffective is in no small part a result of Christie's design, and rank and file membership being both apathetic and demoralized. It is a fact that there have been a lot of long hours, hard battles and some small victories but from the moment this guy was elected, Christie has had one singular goal. He claims to be fighting for New Jersey but in the end, every major initiative, plan and committee has had one marching order; destroy the unions. If the union membership doesn't step up and contribute to the fight to defend themselves instead of cowering in the corner and hoping that the union leadership can pull off a Hail Mary, Mr. Christie will get his wish.

Locals are just starting to let the membership know that the Black Friday Holiday ruling will stand.

The decision by the Christie administration not to appeal the PERC ruling was trickled out last night from the state house.

Doesn't Chris Christie get it? he's targeting everyone the teaparty disagrees with, and eventually someone that even the most ardent supporters of the teaparty knows will be squashed by the governor's short sighted bullying. Eventually everyone in the state will know someone who was beaten up by this guy.

NJN -- The Fight's Just Heating Up (4.00 / 3)
Thanks to Couch Potato for pointing out the contract language concerning job security and the displaced work pool.  Contractually, the state was obligated to provide CWA with complete financial information regarding NJN in early September to allow us to craft a financial plan for NJN to demonstrate the ability of the concern state employees to efficiently run NJN.   We will ultimately prevail in this matter as we did concerning the Day After Thanksgiving (BTW -- the Christie administration is NOT appealing the PERC ruling and union represented state employees WILL get the Day After Thanksgiving as a holiday.)

The entire legislature agrees that the NJN shouldn't be funded by the state anymore.  What do you possibly think you can do to keep the state funding?

The workers,and everyone else knew IN APRIL that the funding for NJN would be cut as of December 31.

These layoff notices were no surprise. What is a surprise is the total lack of preparation done by everyone INCLUDINGTHE UNION to transition these workers into a new working organization that will continue the fine programming under a different format.

The CWA once again wasted time fighting something that was already lost!Look at this quote from the CWA union leader printed in the Phila. Inquirer today:

Communications Workers of America Local 1032 president Patrick Kavanagh called on the governor and Legislature to provide funding until a deal can be completed.

"To convert NJN to another form requires authorizing legislation to be passed, an audit of assets to be done, and for the Federal Communications Commission to approve a license transfer," Kavanagh said. "That's not going to happen in a month and half."

Yesterday, 45 days before these people are going to be let go the Union now decides to put pressure for transition funding?

CWADUDLEY states that the NJN workers should " stay tuned" for a new campaign that will start shortly.

These people are out of work in 44 days and the Union is excited about a " new campaign"?

CWA is once again a day late and a dollar short. Preparations should have been worked on to help these people 6 months ago,now with 6 weeks to go they are getting screwed.

The Unions better wake up and realize that you have to be proactive with this Governor. He is going to destroy them if they don't change their approach.

The Union is going to fight over 4 months  severance pay instead of pushing to get the workers at NJN what they really need. These people need the road cleared so that NJN can transition to a new type of entity and everyone can keep their jobs.

I want those people to keep working . The Union must keep its eye on the Big Picture. Use all of its influence to getthe roadblocks out of the way so that the entity can be sold.

What is a better use of your time if you are the CWA . fighting for 4 months severance pay,or fighting to get all the legisaltion and bureaucratic B.S. out of the way so that those peopel at the new NJN can keep working?

Latest information leaking out of the State House has Mr. Christie, in response to PERC's ruling against him and in favor of the unions, now forcing all non-union staff into work on Black Friday. Non-union staff accounts for approximately 30% of the state's public workforce, creating a truly skeletal staffing situation. The question is whether this is a tactical maneuver to demonize the unions in the press or an attempt to create a rift within the public workforce. Or could it be a selfishly motivated attempt to save face after the PERC ruling went against him?

Mr. Christie is claiming that this holiday is somehow an additional paid holiday when it is, in fact, a swapped day off with Lincoln's Birthday. There are no additional costs to the state involved with this day being given as a holiday since it is an exchanged day.

Instead, because of his ego and anger, Mr. Christie will be putting additional costs on the state in the way of utilities used to light and heat the state buildings that will be occupied with mere skeleton staff to support a public very unlikely to be seeking states services on Black Friday.

Once again, Mr. Christie is proving that his skill sets do not include effective governance but rather combative attacks and manipulations in order to further his anti-union agenda, even at the cost of tens of thousands of dollars to the state and unfair victimization of non-union staff.

Christie loves turmoil. In that way he can call NJ 1015 and brag about how he is working and the union people are not.

If the unions were smart they would publicly appeal for the Governor ,in the spirit of the holiday, to make that day a voluntary work day for all non-union workers.

but the weight of his hatred for the working class will sink him eventually. Too much baggage to negotiate the political minefield.

Word has begun to go out to state workers that Mr. Christie is requiring non-union employees to report to work on Black Friday.
This will leave almost every department severely understaffed.

Will this prompt Mr. Christie to offer costly over-time to unionized workers or will he expect non-union (mostly management) employees to carry the load with a 70% reduction in staff? In some of these offices, there is an issue of personal safety to be considered as well as many of them are located in high crime areas and will be reduced to as few as one or two non-union employees. Is this yet another example of him putting the safety and welfare of all state employees second to his personal grudges and ambitions?

It is becoming ever more apparent that competently governing the state of New Jersey is beyond this man's ability.
