Oury pleads guilty: Ferriero next?

by: Hopeful

Tue Sep 29, 2009 at 10:42:03 AM EDT

NorthJersey.com/The Record is reporting that Attorney Dennis Oury pleaded guilty this morning "to charges of defrauding the residents of Bergenfield, conspiracy to commit mail fraud and failing to file a tax return for 2006." Opening arguments had been scheduled for the day after tomorrow.

I'd say the obvious issue is whether Oury made a deal to testify against Joe Ferriero.

Update (10:53AM) It's so obvious I should have waited to see Joe Ryan of NJ.com's account:

"Did you and Joseph Ferriero deliberately set up and structure this company so that your involvement would not be publicly known to others?" asked U.S. District Judge Stanley R. Chesler.

"Yes," Oury said.

let's hope so (4.00 / 3)
Though of course Ferriero is innocent until proven guilty.

...one of these go to an all out trial in which all the dirt is brought to public light......when the point of giving a thirty year sentence is at hand.....THEN you offer the criminal the option of totally spilling his guts in exchange for a massively reduced or even eliminated sentence.

Imagine what would happen to politics in NJ if someone at the level of a Joe Ferriero ever totally came clean and totally spilled his guts!

Only the prospects of a massive prison sentence is a real prison (no club feds) would come close to being able to motivate that kind of disclosure.

These bums walk away with light sentences in light confinement...and the corrupt SYSTEM marches on, essentially unaffected.

The Ferriero case (4.00 / 1)
I'm really looking forward to following the trial.  It would become especially interesting if Oury testifies against Ferriero, so fingers crossed.

By the way, anyone who hasn't should read the indictment. It alleges some pretty desipicable stuff.

I know we at Blue Jersey have been bashing Chris Christie for quite some time now, and with good reason, but the reality is that his tenure as a U.S. Attorney did yield a lot of worthy indictments and convictions of corrupt NJ politicians. Now let's get a U.S. Attorney who will prosecute corruption on both sides of the aisle.  (Paul Fishman, I hope.)

Big difference between Oury & Ferriero (0.00 / 0)
Oury had no choice but to plead guilty. He didn't file taxes on the money he made (you can bet Ferriero did or he would also be charged with tax evasion).

But Oury's biggest problem is that he worked for the town of Bergenfield and as an employee he had a legal duty to disclose his interest in the company, while Ferriero did NOT work for Bergenfield and had no legal duty to disclose anything to anyone.

The only way Ferriero can be found guilty is if the jury believes he helped Oury avoid disclosing Oury's conflict. There is nothing strange or unusual about the principals of a corporation not putting their names on legal papers as directors or officers. That is very common. But can the prosecutor prove beyond a reasonable doubt, as he must, that the reason Ferriero did that was to help Oury hide his interest rather than to keep those who regularly peruse public records from getting their noses into what Ferriero considered his private business?
